ByGift Creator Policy & Agreement

2. Contributor Eligibility

To participate as a Contributor on ByGift, you must:

1. Be at least 18 years old
2. Have legal capacity to enter a binding agreement
3. Provide accurate and complete information
4. Comply with all applicable laws and platform policies

ByGift may request identity verification or supporting documentation where necessary.

3. Contributor Role

Contributors may provide:

1. Creative digital content
2. Visual or multimedia content
3. Themed digital collections
4. Interactive digital media
5. Educational or entertainment-focused content
6. Platform-approved branded or curated materials

Contributors acknowledge and agree that:

1. ByGift controls how content is organized, displayed, and made available
2. ByGift determines platform presentation, availability, pricing, and access structure
3. Contributors act solely as content providers to ByGift
4. Contributors are not independent sellers, merchants, or service providers to users

4. Ownership and Platform Rights

All content submitted to ByGift may be reviewed, adapted, organized, reformatted, branded, distributed, or incorporated into platform-managed collections by ByGift.
By participating on the Platform, Contributors grant ByGift a worldwide, non-exclusive, royalty-free license to:

1. Host, display, distribute, reproduce, and present contributed content
2. Modify formatting or presentation for platform compatibility
3. Use contributed materials for platform operations, promotion, and marketing
4. Include contributed materials within platform-managed digital collections

ByGift maintains full control over how content is presented and delivered within the Platform.
Nothing in this Agreement creates a marketplace relationship between Contributors and users.

5. Independent Contractor Relationship

Contributors participate as independent contractors.
Nothing in this Agreement creates:

1. Employment
2. Partnership
3. Joint venture
4. Agency relationship

Contributors are responsible for:

1. Their own taxes and legal obligations
2. Their own equipment and tools
3. Compliance with applicable laws

6. Contributor Compensation

Contributors may receive compensation from ByGift for approved content contributions.
Compensation structures may include:

1. Fixed compensation
2. Licensing arrangements
3. Project-based payments
4. Promotional collaborations

All compensation arrangements are determined solely by ByGift.
Users do not pay Contributors directly.

7. Platform Control

ByGift maintains full control over:

1. Content publication
2. Content organization and branding
3. Pricing and access structure
4. Promotions and marketing
5. Platform availability
6. User access and delivery systems

Contributors acknowledge that ByGift solely manages the platform experience presented to users.

8. Content Standards

Contributors must ensure that submitted content:

1. Is lawful and appropriate
2. Does not infringe third-party rights
3. Is not misleading or deceptive
4. Does not contain prohibited or harmful material

Prohibited content includes:

1. Illegal material
2. Hate speech or discriminatory content
3. Fraudulent or deceptive content
4. Explicit or prohibited material
5. Copyright-infringing material

ByGift reserves the right to reject, remove, modify, or restrict content at any time.

9. Platform Moderation Rights

ByGift may:

1. Review content before or after publication
2. Modify content presentation or organization
3. Remove content or collections
4. Suspend or terminate Contributor participation

These measures help maintain platform quality, consistency, and user trust.

10. Fraud Prevention and Compliance

ByGift may monitor platform activity for:

1. Fraud
2. Abuse
3. Misrepresentation
4. Violations of platform policies
5. Security risks

Contributors must cooperate with reasonable compliance and verification requests.

11. Prohibited Contributor Activities

Contributors must not:

1. Sell directly to users outside the Platform
2. Request or accept direct payments from users
3. Promote external payment methods
4. Misrepresent content or platform affiliation
5. Attempt to bypass platform systems
6. Use the Platform for unlawful or deceptive activity

Violations may result in immediate removal from the Platform.

12. Content Availability

ByGift does not guarantee that contributed content will remain available indefinitely on the Platform.
ByGift may:

1. Reorganize content
2. Discontinue collections
3. Modify presentation formats
4. Remove content at its discretion

13. Content Licensing Compensation

Contributors may receive compensation from ByGift for licensed content provided to the Platform.
All compensation is determined solely by ByGift under separate agreements and is not linked to individual user transactions or purchases.
ByGift does not pass payments from users to Contributors, and users do not pay Contributors directly.
Compensation may be adjusted, delayed, or withheld where:

1. Content is under review for quality, compliance, or legal checks
2. Platform policies or content standards are violated
3. Content is found to infringe third-party rights or applicable laws
4. Fraud, abuse, or misrepresentation is suspected
5. Technical or verification processes require temporary review

14. Termination of Participation

ByGift may suspend or terminate Contributor participation at any time if:

1. This Agreement is violated
2. Fraudulent, deceptive, or harmful activity is detected
3. Content does not meet platform standards
4. The Contributor negatively impacts platform integrity or trust

Contributors may request removal from the Platform by contacting support.

15. Limitation of Liability

To the maximum extent permitted by law, ByGift is not liable for:

1. Loss of earnings or business opportunities
2. Platform interruptions or downtime
3. Removal or modification of content
4. Third-party actions affecting platform operations

Any liability of ByGift shall be limited to unpaid approved compensation owed to the Contributor, where applicable.

16. Confidentiality

Contributors agree to keep confidential any non-public information relating to:

1. Platform operations
2. Compensation arrangements
3. Internal policies
4. Platform systems or procedures

Unauthorized disclosure may result in termination of participation.

17. Changes to This Agreement

ByGift may update this Agreement from time to time.
Updated versions will be published on the Platform, and continued participation constitutes acceptance of revised terms.

18. Governing Law

This Agreement is governed by the laws applicable in the jurisdiction where ByGift is legally established, subject to applicable digital commerce and consumer protection regulations.
