Refund Policy

ByGift ("ByGift", "we", "our", or "us") provides access to digital content packages through its platform. This Refund Policy explains when refunds may or may not be issued for purchases made through www.bygift.app or related ByGift services.
By using ByGift, you agree to this Refund Policy.

1. Nature of ByGift Services

ByGift provides digital access to curated digital content packages hosted within the Platform.
Each purchase:

  1. Is delivered electronically
  2. Provides access to a clearly defined digital content package
  3. Is linked to a ByGift account
  4. Is accessible only through the Platform

ByGift does not provide:

  1. Stored balances or prepaid wallets
  2. Transferable credits or redeemable value
  3. Financial or payment services
Each purchase relates only to the specific digital content package selected at checkout.

2. Digital Content Access Model

ByGift operates a direct digital access model:

  1. A user selects a digital content package
  2. The user completes a purchase
  3. Access becomes available within the Platform
  4. The user accesses the content through their ByGift account

Once access has been activated or made available within the account, the digital service is considered delivered and fulfilled.

3. EU Consumer Rights and Digital Content

If you are located in the European Economic Area (EEA), you may have statutory rights regarding digital purchases.
By completing a purchase on ByGift, you expressly agree that:

  1. Access to digital content may begin immediately
  2. The digital service may be delivered without delay
  3. Performance of the digital service begins once access is activated or made available

Where permitted under applicable law, withdrawal rights may no longer apply once digital content delivery has started.

4. Non-Refundable Situations

Refunds will generally not be provided where:

  1. Access to digital content has been successfully delivered
  2. Content has been activated, viewed, or accessed
  3. The purchase was completed intentionally
  4. You change your mind after purchase
  5. Incorrect recipient or account details were provided
  6. Access was assigned to the wrong recipient due to user error
  7. The issue relates to personal preference or dissatisfaction

Once digital access has been delivered or activated, the purchase is generally considered final.

5. Eligible Refund Cases (Limited)

Refunds may only be considered in the following rare situations:

  1. Payment was completed but access was not delivered
  2. A verified technical issue prevented access
  3. Duplicate charges occurred due to a system error
  4. Unauthorized use of a payment method is confirmed following review

All refund requests are reviewed on a case-by-case basis.

6. Ineligible Refund Cases

Refunds will not be issued for:

  1. Successfully delivered or activated access
  2. Partially used or accessed digital content
  3. Incorrect information submitted by the user
  4. Failure to access content due to account or device issues outside ByGift’s control
  5. Promotional or discounted purchases unless required by law

7. Refund Request Process

If you believe your purchase qualifies for a refund under Section 5, you must:

  1. Contact ByGift Support within 48 hours of the transaction
  2. Provide:
    1. Transaction ID
    2. Registered email address
    3. Description of the issue
  3. Allow time for investigation

If a refund is approved:

  1. Refunds are issued to the original payment method
  2. Processing time may take 5–10 business days, depending on your payment provider
  3. Transaction or processing fees may be non-refundable

9. Chargebacks & Disputes

If you experience an issue with your purchase, we encourage you to contact ByGift Support before initiating a chargeback.
ByGift reserves the right to review and respond to chargebacks or payment disputes using relevant transaction and access records.
Fraudulent or abusive dispute activity may result in account restrictions or suspension.

10. Compliance & Consumer Rights

This Refund Policy complies with:

  1. Digital services regulations
  2. Payment processor requirements
  3. Applicable consumer protection laws

Where required by law, mandatory consumer rights will be honored. Nothing in this policy limits statutory rights that cannot be excluded.
